Terms of Business
These terms of business apply to all contracts for the supply of goods made with Castle Bryher Limited and the person purchasing the goods. Any amendment or alteration must be agreed in writing

Orders
All orders shall be deemed to be an offer by you to purchase items in accordance with these conditions. An order will lapse unless unconditionally accepted by us by e-mail within seven working days.
Availability
The descriptions of items displayed on our website are as accurate and up-to-date as possible. No order shall be treated as accepted by us until we confirm that it is accepted by e-mail. If two orders are placed for the same item, they will be dealt with in strict order of time of receipt. If you order any item which, for any reason, is unavailable, you will be informed by e-mail as soon as possible and the order will not be accepted and no funds will be transferred from your account.
If, for any reason, we cannot deliver an item ordered by you with seven days of confirmation that your order has been accepted, we will advise you by e--mail as soon as reasonably possible.
Shipping And Handling
Dates given for shipment or delivery are stated in good faith, but are not to be treated as a condition of sale. We are not liable for any loss caused by delay in delivery beyond those dates. In all instances, parcels will have to be signed for on delivery. All goods should be examined for any obvious loss or damage at the time of delivery and, where necessary, the evidence, including the goods and packaging, retained. We accept no liability whatsoever for any loss through short delivery or damage to goods unless you notify us by e-mail within 24 hours of the time of delivery. Any claims for damage to goods during transit will be dealt with through insurers.
UK ADDRESSES
Shipping to UK addresses is free of charge. Delivery will be by either recorded delivery (small, low-priced items only) or by insured special delivery.
COUNTRIES OUTSIDE THE UK
The cost of shipping is not included in the item price, as it varies depending upon your address. A shipping charge is automatically calculated and added to the form before you are asked to confirm your order. Delivery will be by insured courier or by insured priority airmail.
Liability
The quality and description of items shall be as described on these pages. As the goods are second hand, all terms, conditions and warranties (including those implied by statute or otherwise), other than those expressly set out in these conditions, relating to the quality and/or fitness of goods for any purpose are excluded.
Under no circumstances shall the liability of Castle Bryher Limited exceed the price of the goods ordered.
We shall be under no liability whatever (and hereby exclude liability) for any indirect or consequential loss, damage, cost or expense of any kind whatever and however caused, whether arising under contract, tort (including negligence) or otherwise including (without limitation) loss of business, earnings, profits or contracts.
We shall not be liable in any circumstances for any loss, damage, injury or delay due to circumstances or any cause beyond our control in relation to the delivery items or the performance of our obligations.
Notwithstanding any of the above, we do not limit our liability for death or injury caused by our own negligence or that of our employees, agents or sub-contractors.
Quality & Condition of Goods Sold
Wherever possible, we buy perfect or good condition items to stock. However, we do occasionally buy items, which have been restored by others, and items with small chips or cracks, which we then restore to a very high standard. (Our ceramicist has a national reputation for the quality of her work and was recommended to us by a major international auction house.) Where any item displayed on these pages has been restored, this is clearly noted in the description. Significant faults are always noted, but crazing, where minor and unobtrusive, is not. If you are in any doubt about the condition of a piece, please e-mail us before your order on enquiries@castle-bryher.com quoting the item concerned, your name and the nature of your enquiry. We will then e-mail you back the answers to you questions. We are happy, within reason, to e-mail additional photographs on request.
Prices, Import Duties & Local Sales Taxes
The prices shown against individual items do not include VAT. Where this applies, it is automatically calculated and added to the form before you are asked to confirm your order.
Although we reserve the right to alter prices of items from time to time at our complete discretion, once you have confirmed an order, the price of the item ordered (which shall be set out on this site at the time you place your order) will not be altered.
The recipient is solely responsible for the payment of import duties and local sales taxes, if any, in the country of receipt. Such duties and taxes are not included in the prices quoted and will not be automatically added to the price of your order when you confirm it. This site contains no details of when such taxes will or might be chargeable.
Payment by Credit & Debit Cards
By placing an order you authorize us to charge the price for all items ordered, delivery and insurance charges and VAT(if any) to your debit or credit card. However, we will not process the charge until the day on which the goods are despatched. Legal title to the goods will pass to you on receipt by us of payment in full which must be effected by a valid credit or debit card transaction.
All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption. Card transactions are undertaken by NETBANX on our behalf. We do not receive or hold your Credit Card details.
Please note that we do not intend to confer any benefit on any person other than the person named on the debit or credit card used to pay for the items ordered and do not intend that any term of contract made pursuant to these conditions should be enforceable by anyone other than that person.
Guarantee
You will be permitted a period of seven working days starting with the date of delivery within which you may withdraw from the contract without penalty. Such withdrawal must be effected by sending an email to customerservices@castle-bryher.com intimating this intention. If you do withdraw from the contract within the period of seven working days, we will refund you the price paid for those items you wish to return less any direct costs incurred by us in retrieving the item or items concerned.
Your satisfaction is important to us. If you have any comments or complaints about the service we provide, please contact us on customerservices@castle-bryher.com. We will then investigate the matter thoroughly and will offer a refund of the purchase price of the item, if appropriate.

Castle Bryher Limited does not disclose buyer's information to third parties. Cookies are used on this shopping site to keep track of the contents of your shopping basket once you have selected an item, to store delivery addresses (if the address book is used) and to store your contact details (if you select the 'Remember Me' option).

Law
These terms & conditions shall in all respects be governed by and construed in accordance with English law and shall be subject to the non-exclusive jurisdiction of the English Courts.
